Any website is subject to a suit without any requirement to give notice to fix the issue. The U.S. Senate blocked a House of Representatives bill to allow for 60 days notice so there is no relief in site in the near future. We cannot guarantee you won’t receive a letter from an unscrupulous lawyer, but your reasonable attempt to make your site accessible as defined by the Ninth Circuit Court and Assistant Attorney General, Stephen E. Boyd, who stated in a letter of Congress that entities (individuals, businesses, companies, organizations, etc.) have flexibility in how to comply with web accessibility means you have made a reasonable attempt.
The best way to protect your site is to make it ADA Compliant/accessible. That includes:
- Adding ALT tags to every image
- Providing a Zoom option
- Fixing contrast issues for text
- Adding a Text to Voice option
- Creating an Accessibility Policy and posting it
Items 1-4 must be added for EVERY page on your site.
It’s possible to do this manually, but the cost can exceed several thousand dollars. Or,
You can let us add ADA Compatibility for a much lower price. Our service includes all 5 items above and helps protect you from lawsuits. Just having this in place makes you too difficult a target for lawyers.
The following is excerpted from an article available at: https://www.businessnewsdaily.com/10900-ada-website-requirements.html
“While ADA website compliance is a bit subjective and open to interpretation, it’s not too difficult to discern what is meant by “reasonable accessibility.” By making a good-faith effort to achieve reasonable accessibility for users with disabilities now, businesses can get ahead of the regulatory curve in developing a compliant website and avoid potential lawsuits. Moreover, designing a compliant website can lead to more sales and better ranking on search engines for a modest investment.”
